Definition:
Since 1989 in the United States, an optional method of applying for federal registration of a trademark based on a declared intention to use the mark on specific goods or services.
Common Law Rights
Definition:
Property or other legal rights that do not absolutely require formal registration in order to enforce them.
Current Filing Basis
Definition:
In applications under §§1 and 44 of the Trademark Act, the applicant may claim more than one basis, and may add or substitute a basis after filing the application.
